These general terms and conditions of sale and general conditions of the iconicjungle.com website, are the exclusive property of the brand “ICONIC JUNGLE, my head is a jungle” and therefore of its legal owner. On the texts below we name the brand in a shorter way as now indicated as: ICONIC JUNGLE.
2. Retention of ownership
The Products ordered remain the property of ICONIC JUNGLE until full payment of the price has been received by ICONIC JUNGLE.
However, you assume the risks (in particular of loss, theft or damage) concerning the Products delivered as from the moment they are delivered to the address indicated at the time of ordering.
3. Scope and acceptance of the general terms and conditions of sales
The purchase of products offered on the website www.iconiquejungle.com is subject to the present general conditions of sale of the Site (“General Conditions of Sale”). The use of the distance selling service governed by these General Terms and Conditions of Sale is exclusively reserved for end consumers, persons who are not acting for commercial, entrepreneurial or craft purposes or in the context of potential professional activities, having reached the age of 18 (or, for younger persons, authorised by their legal representative). The resale or transfer of products purchased on the Site for commercial or professional purposes is expressly prohibited. We may update these General Terms and Conditions at any time. You can consult the latest version of the current General Terms and Conditions of Sale at any time by clicking on the link “General Terms and Conditions of Sale”. The General Terms and Conditions of Sale in force at the time of conclusion of the sales contract are those that are enforceable against you. The languages used for the purpose of concluding the contract of sale on this Site are French and English. In addition, each time you purchase Products on the Site, you will be asked to confirm your acceptance of these General Terms and Conditions of Sale in effect on the date of placing your order. These general terms and conditions can be viewed before and at the time you are asked to confirm that you accept them.
4. How to Order
The Site allows you to order from ICONIC JUNGLE a selection of products from the brand “ICONIC JUNGLE my head is a jungle” (hereinafter the “Product(s)”), immediately online via the Internet for delivery to Switzerland, Europe, the United Kingdom, the USA, Asia…..
5. Product Availability
Our Product and price offers are valid as long as they are visible on the Site. Currently our leather goods are only made to order, so we do not have any stock. This is why when you place your “pre-order”, you are informed of the waiting time for the preparation and delivery of your product.
5.1. Some Products may occasionally be unavailable, although only appearing on the Site. In such circumstances, ICONIC JUNGLE will promptly inform the Customer by email that the order placed has not been accepted by ICONIC JUNGLE.
5.2. The Customer acknowledges that the products offered by ICONIC JUNGLE on the Site are limited in number and therefore he/she is aware that ICONIC JUNGLE will need to check availability at the time of purchase.
5.3 Errors or modifications may exceptionally exist, in particular in the case of simultaneous orders of the same Product by several customers. In the event of unavailability of a Product after placing your order, we will inform you by e-mail as soon as possible (within 3-5 days), offering you either to order another Product presented on the Site in replacement, or to cancel your order.
5.3 ICONIC JUNGLE is not liable in the event of unavailability of the Products for orders not yet accepted by ICONIC JUNGLE.
5.4 ICONIC JUNGLE reserves the right to change the Products offered on the Site at any time and without notice. In order to ensure a better quality of service and availability of our Products to all customers of the Site, ICONIC JUNGLE reserves the right to limit the quantity of Products that can be purchased by a customer, in accordance with the applicable provisions in this regard.
6. Purchase procedure and payment of your order
6.1. Each Product offered for sale on the Site can be viewed by following a link provided for thispurpose, displaying photographic images of the item, unit price, colors, and sizes (if applicable). For Products expressly marked on the Site as not yet available for delivery (hereinafter “I want it! “Pre-order”, “Pre-order Product” or « Customized Products”), as not yet ready to be shipped, the link provided for this purpose or a personal e-mail, will also give you the corresponding estimated delivery date.
6.2. Although every effort is made to ensure that the photographs displayed on the Site accurately correspond to the original Products, there may be discrepancies due to the technical characteristics and color resolution of the equipment used by the Customer. Consequently,
ICONIC JUNGLE declines all responsibility for any inadequacy of the graphic representations and cannot be held liable for non-substantial errors or inaccuracies in the photographs or graphic representations of the Products appearing on the Site. All images and pictures present on the website are not contractual.
6.3. The Customer may purchase one or more Products, for a maximum of 3 units per same Product, except for certain types of Products mentioned. ICONIC JUNGLE reserves the right to modify at any time the limitations on the number of Products that may be purchased through the Site.
6.5. The purchase procedure is finalized as soon as the Customer presses the confirmation button of the final Order, thus validating his order which will be directly submitted to ICONIC JUNGLE. After pressing the Purchase Button, the content of the Order can no longer be modified by the Customer.
6.6. Before finalizing and sending the Order, the Customer must confirm that he/she has read and accepted these General Terms and Conditions of Sale. At the end of the purchase procedure. The purchase procedure must be fully completed; a failure to do so implies that the Order cannot be submitted to ICONIC JUNGLE.
6.8. The Customer is aware that he/she is responsible for the accuracy and veracity of the data entered on the Site or used in any other way at the time of purchase.
6.9. The Customer is informed that on the Site, he also has the possibility: to pre-order a selection of Products before their launch, distribution or placing on the market, and to order Products that it wishes to customize permanently by adding modifications according to
the terms indicated on the Site. The Customer acknowledges that these Products are not yet available for delivery at the time of the Order. These Products are clearly identified and indicated on the Site by the words “I want it”, “Pre-order” or “Pre-order Product”, and the Products that can be customized by Customers are clearly identified and indicated on the Site by the words “Customized Products”.
6.10. The Customer acknowledges and accepts that if he orders a Pre-Ordered Product and/or a Custom Product, the price indicated on the Site and displayed in the Basket will be charged to him upon receipt of the Confirmation Email, although the Pre-Ordered Product and the Custom Product are not yet ready to be shipped on that date. The Pre-Ordered Product and the Custom Product will be delivered to the Customer on the relevant estimated delivery date, specified in the Product Description Sheet.
6.11. In the event that the Order sent by the Customer also contains one or more Pre-Ordered Products and/or Custom Products in addition to the Products already available, all prices corresponding to this Order shall be debited at the time of receipt of the Confirmation Email even if these Pre-Ordered Products and Custom Products shall only be delivered on the corresponding estimated delivery dates, as specified in the Product Description Sheet.
6.12. The Customer acknowledges and accepts that, with the exception of what is specifically provided for in these Pre-Ordered Products and Personalized Products, the other clauses of these General Terms and Conditions of Sale apply to Pre-Ordered Products and Personalized Products.
6.13. Once completed, your order is sent to ICONIC JUNGLE for processing. ICONIC JUNGLE reserves the right not to accept an order from a customer with whom it is in dispute for a previous order, or if ICONIC JUNGLE reasonably believes that the customer has violated these Terms and Conditions or has engaged in fraudulent activity, or for any other
7. Confirmation of the order
A summary of your order will then be sent to you by e-mail. The acknowledgement of receipt shall include the total amount of the order, information relating to cost and delivery time, essential characteristics, quantity and price of the Products purchased.
We recommend that you keep this acknowledgement of receipt on paper or electronic media.
8. Prices and payment methods accepted
8.1. The prices of all Products offered for sale on the website include VAT.
8.2. Prices are expressed in Euros (EUR).
8.3. The total price indicated in the Basket includes shipping costs, if any others, which are indicated separately. In all cases, ICONIC JUNGLE must obtain the express consent of the Customer to charge additional costs.
9. Payment by credit card or bank card
9.1. The accepted credit cards and bank cards are: Visa®, MasterCard®, Maestro® American Express®. We draw your attention to the fact that the issuer of your credit card may charge you a processing fee. ICONICJUNGLE cannot be held responsible for the application of such fees.
9.2 With regard to credit card payments, the Customer confirms and warrants that he/she is the holder of the credit card used for the purchase and the accuracy of all data entered at the time of purchase, such as: credit card number, expiry date and, if applicable, security code.
9.3. The purchased Products are only delivered after payment of the amount due by the Customer. In the event that the Customer cannot debit the amounts for any reason whatsoever, the sale procedure automatically ends and the sale is cancelled, and the Customer is subsequently informed.
9.4. In the event that one or more Products are unavailable and the Customer has decided not to cancel the order entirely, he/she is only charged the price of the available Products and the potential related shipping costs.
10. Delivery conditions and transport costs
10.1. For the EDEN BAGS, we do offer complimentary worldwide shipping. For the other Leather Goods or EDEN / collections, Standard delivery is offered for the European Union. A flat-rate shipping fee will be charged in addition for shipments outside the European Union.At the beginning of the ordering process, we indicate the possible delivery times and shipping formulas for the Products purchased and the chosen delivery country. This amount will be due by you in addition to the price of the Products purchased.
10.2. The Products are delivered to the address indicated by the Customer in the Order and we will send you the tracking number of your package by e-mail. The Customer will receive the Products separately as soon as they are ready for shipment. For security reasons, a signature is required upon receipt of all orders.
10.3 All our orders are shipped in our signature packaging and placed in a neutral and discreet cardboard box. If your purchase is a gift, please note it in “additional information” at the time of payment, or check the box “This is a gift”, before entering the delivery address. You will receive your order elegantly packaged and if you wish, you can add a personal message. As the prices are not visible, gift orders can be shipped directly to the recipient.
10.4. Please note that the tracking number will be activated within 24 hours of the order being shipped. Therefore, tracking may not be available immediately after shipment. Please check again the next day.
10.5. For security reasons, ICONIC JUNGLE does not process any order addressed to a post office box and does not accept any order that does not identify the natural person held to be the recipient of the order or the address in question. In cases where the Order concerns Pre-Ordered Products and/or Customised Products, the delivery time will be more than 30 days and ICONIC JUNGLE will deliver these Products on the date or during the estimated delivery period agreed with the Customer, as indicated to the Customer in the Product description sheet.
10.6 With regard to a Pre-order of several articles simultaneously, ICONIC JUNGLE reserves the right to modify the estimated delivery time on the website and will promptly inform the customer.
10.7 As soon as the purchased Product is shipped, the Customer receives an email to the address indicated in the Order. This email contains a shipping tracking code and a link that allows the Customer to track the delivery in real time.
10.8. The Customer bears the risk of loss or damage to the Products from the moment he/she, or a third party designated by the Customer and other than the carrier, physically takes possession of the Products. In the event that, on the other hand, the loss or damage to the Product occurs before physical delivery to the Customer or to a third party designated by the Customer, ICONIC JUNGLE shall refund to the Customer any amounts already paid. Any damage noted or occurring after receipt of the goods is the responsibility of the Customer.
11. Delivery to the hotel
We can deliver without any problem to your hotel. Please enter the name of the hotel when entering your delivery address. Please remember to indicate the dates of your stay in the “additional information” field so that we can ensure that we can deliver you on time. If this is not the case, we will contact you again to inform you.
12. Delivery problems
12.1. Any defect or delay in delivery, exceeding the delivery times mentioned, must be reported by e-mail, mentioning your name and order number, to our Customer Service as soon as possible. Our customer service will do everything possible to unblock the delivery as soon as possible, but we cannot be held responsible for customs problems and their particular delays in certain cases. Any claim made after thirty (30) calendar days after the date of validation of your order cannot be taken into account.
12.2. In the event that ICONIC JUNGLE does not deliver the Products ordered within the aforementioned period, the Customer must set ICONIC JUNGLE a suitable additional period of time to deliver the Products in question, in accordance with the applicable laws currently in force.
13. Product Compliance and Legal Warranties
13.1. At the time of delivery, the Customer must check the Products to ensure that they correspond to the items ordered and that they do not present any manufacturing defect or lack of conformity. The sale of « ICONIC JUNGLE” Products is subject to the legal warranties provided by applicable laws and any additional contractual warranties that ICONIC JUNGLE may provide to the Customer.
13.2 Legal warranties
The Products sold by ICONIC JUNGLE are subject to the conditions of legal guarantees provided by the federal law supplementing the Swiss Civil Code (Book Five: Law of Obligations), to the exclusion of all other guarantees.
13.3 Legal guarantee of conformity
ICONIC JUNGLE will deliver to you a Product that complies with the contract and is free of defects in conformity upon delivery of the said Product, in the sense that the Product will be suitable for the use usually expected of a similar good and that it will have the characteristics
presented during the sale. ICONIC JUNGLE is also liable for defects in conformity resulting from packaging when it has been charged to it by the contract or has been carried out under its responsibility. This guarantee will only be valid if you request it within two years of delivery of the property. Any lack of conformity which becomes apparent within twenty-four (24) months of delivery shall be presumed to exist at the time of delivery, unless proven otherwise. You may choose between repairing or replacing the Product unless one of these choices results in a manifestly disproportionate cost to ICONIC JUNGLE. If it is impossible to repair or replace the Product, you may return the price paid by returning the Product, or keep the Product and have part of the price returned to you, unless the lack of conformity is minor. The return, replacement or refund of the Product shall be made at no cost to you and shall not prevent you from receiving any compensation in the event that you are entitled to it. The legal guarantee of conformity applies independently of the commercial guarantee indicated in Article 12.2 below.
13.4. Legal guarantee for hidden defects
ICONIC JUNGLE will give you a Product free of hidden defects that would make it unfit for its intended use, or that reduce this use so much, that you would not have acquired it, or would have given only a lower price, if you had known them. This warranty will only apply if you make the request within two (2) years of the discovery of the defect. In the event of a hidden defect, you will have the choice of returning the Product and having the price and costs incurred by the sale returned to you or keeping the Product and having part of the price returned to you. In any case, it will be up to you to prove that you meet the conditions of the guarantee. In case of lack of conformity and hidden defects please contact our Customer Service, who will send you all the necessary information for the return. You have fourteen (14) days to return your package.
14. Right and withdrawal period
14.1. ICONIC JUNGLE’s general refund policy allows you to withdraw within thirty (15) days of the date of delivery of the Products, without having to justify any reasons and without having to pay any penalty. After this period, you will no longer be able to exercise your right of withdrawal.
14.2. Personalised products cannot be exchanged or refunded.
15. Returns and refunds
15.1. The Customer has the right to revoke the contract within 14 (fourteen) days of delivery or withdrawal of the Products, except for Personalized Products. For Split Orders, the period begins on the day of delivery or withdrawal of the last Product.
15.2. Return conditions
You have the possibility to return, for an exchange or refund request, any product ordered on the iconicjungle.com website within fifteen (15) calendar days of the delivery date. The returned products must be accompanied by their purchase invoice or a copy in case of partial return. The return of a product, in case of exchange or refund request is offered using our prepaid return system. With regard to an exchange of a product, you only have the possibility to request it for items of the same value. The Customer must take into account the fact that for “Leather Goods”, all parts are made only at the time of order, to carry out an exchange of goods, he will have to wait for the time of design and delivery of a new part. Also, a financial contribution will be requested for the cost of return and a new delivery. If you cannot or do not wish to use the prepaid return service, please contact us and notify our customer service by email, so that they can record your return. In this case, it is your responsibility to prove that the goods have been returned and to return them by an authorized carrier of your choice who will provide proof of shipment and delivery. The cost of returning the goods will be at your expense. ICONIC JUNGLE is not responsible for items returned, which have been lost, misdirected or delivered late by a carrier of your choice. It is your responsibility to assume all risks for these returns, as well as the expenses, insurance and shipping costs associated with these returns.
15.3. Organisation of returns
Once you have sent us an email to arrange for the return of your order, simply follow the following steps. Before making a return request, please ensure that the items comply with the following conditions, in accordance with our Terms of Sales: Items must be in new and original condition, with all their labels and safety devices still attached and accompanied by all their accessories and packaging – incomplete, damaged, worn or altered items will be refused. The request for return must be made within 14 days of delivery of the order. The return package must be delivered to the carrier within 14 days of the date of the return authorization. The package can only be returned from the country where the order was delivered. Items must have been purchased online at iconicjungle.com. Items purchased in other stores will be refused. Return shipping is free if you use our pre-printed DHL label. If you decide to return your order via another shipping service, you will be responsible for the costs. We cannot be held responsible for any loss or damage caused to the returned items.
Items received as gifts can be returned by contacting the person who placed the order.
15.4. Repayment period
After checking the condition of the items, we will accept the return and proceed with the refund.
Verification of items normally takes 3 to 5 business days. The refund will be made as soon as possible after acceptance of the return, directly to your bank account. The credit should appear within about a week from the refund confirmation email. The exact deadline is subject to banking procedures.
16. Limitation of liability
16.1 In no event shall ICONIC JUNGLE be liable for any damage that does not result from a breach by ICONIC JUNGLE of any of its obligations.
16.2 ICONIC JUNGLE reserves the right to change any information on the website at any time without notice.
